By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

For Informational and Self-Tracking Purposes Only: The contents of the Service, including text, graphics, images, data analysis, and other materials — including results from the Burnout Assessment Tool (BAT) — are intended solely for general informational, educational, and personal tracking purposes. Assessment results reflect burnout-related complaints based on a validated research instrument and do not constitute a clinical diagnosis.
Not a Substitute for Professional Healthcare: The Service is not intended to replace professional medical advice, diagnosis, evaluation, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
Never Disregard Medical Advice: Never disregard professional medical advice or delay in seeking it because of something you have read, tracked, or viewed on or through the Service.
Emergency Situations: If you think you may have a medical emergency, call your local emergency services (e.g., 911) or go to the nearest emergency room immediately. If you are experiencing a mental health crisis or thoughts of suicide, call or text 988 (Suicide & Crisis Lifeline) for free, confidential support available 24/7. Do not rely on Flamewarden for emergency or urgent health assistance.
Your privacy and the security of your health data are paramount to us.
Non-Disclosure & Non-Sale: We strictly enforce a policy that your Personal Health Information (PHI) and personal data — including your Burnout Assessment Tool (BAT) scores, check-in responses, and journal entries — will NEVER be sold, rented, or shared with third parties for marketing, advertising, or external commercial purposes.
Data Security: We implement industry-standard administrative, physical, and technical safeguards (including data encryption in transit and at rest via Supabase, and row-level access controls limiting your data to your own account) designed to protect your personal health data from unauthorized access, disclosure, or misuse.
Privacy Policy: Detailed information on how we collect, store, and safeguard your data is available in our Privacy Policy, which is incorporated into these Terms by reference.
Account Creation: To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration.
Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or breach of security.
Eligibility: You must be at least 18 years of age to create an account and use the Service. Flamewarden is not directed at or intended for use by minors.
Grant of License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Flamewarden for your personal, non-commercial use.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OPTIMAL WORKPLACE STRATEGIES LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF DATA, INJURY, PERSONAL HARM, OR OTHER INTANGIBLE LOSSES — RESULTING FROM:
You agree to defend, indemnify, and hold harmless Optimal Workplace Strategies LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or misuse of the Service.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect (e.g., via in-app notification or email). Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
